Jamshedpur: Raiyat gets possession of ancestral land after 10 yrs

Jamshedpur, July 10. Prashant Sardar, a resident of Jugsalai Purani Basti Road, got justice after 10 years.

He got possession of his ancestral land which had got encroachment in Khata No. 61 and 63, Plot No. 530 and 531 (Area 0.00.97 and 0.00.36 hectare respectively) of Ward No. 3 of Jugsalai.

Circle Inspector Himmat Lal Mahto and other officials deputed on behalf of the Sub-Divisional Magistrate, intervened in the presence of a large number of police forces.

  In the year 2011-2012, Prashant Sardar had filed a case for the return of land under the CNT Act in the court of the Deputy Collector, Land Reforms. Only two years later, on December 24, 2014, the court of the Deputy Collector of Land Reforms passed an order in favor of Prashant Sardar to take possession of the land in question. Since then Prashant Sardar kept visiting the offices to get possession of his land.

On October 9, 2020, an application was again filed in the court of DCLR to ensure that the intervention order was passed.

In the light of the order of the DCLR court, the Circle Officer of Golmuri cum Jugsalai issued a notice to the illegal occupant Rajul Gaddi on July 22, 2021, directing him to remove the encroachment from the encroached land within 15 days.

 But the instructions of the Zonal Officer had no effect on Rajul Gaddi. Even the order passed by the DCLR court was not appealed by him anywhere.

While giving an ultimatum, the Zonal Officer said that forceful action will be taken if the encroachment is not removed within the stipulated period.

Meanwhile, the phase of Covid started. Due to which the matter once again went into cold storage. Meanwhile, continuous efforts from the side of Prashant Sardar continued. During the hearing in the court of DCLR, the court was told on behalf of Rajul Gaddi that the land on which he is living was brought in 1937 from Prashant Sardar’s grandfather Sukram Sardar by paying Rs.80. His family has been living since then.

Rajul Gaddi talked about paying tax to the municipality. But could not submit any documents related to the land. Due to which the court passed an order to return the land under Section 71 (A) of the CNT Act.

On the other hand, after 10 years, Prashant Sardar, his brother Subol Sardar and the family members are very happy after getting the possession of their ancestors’ land.
