New Delhi / Jamshedpur, Nov 24: The Supreme Court on Monday issued notices to the Union government, all states and Union Territories on a writ petition filed by Jamshedpur resident Jawaharlal Sharma seeking a national mechanism to compensate victims of wrongful or arbitrary detention.
A Division Bench comprising Justice Vikram Nath and Justice Sandeep Mehta heard Writ Petition (Civil) No. 1147/2025 and sought responses from the concerned parties after a brief hearing. Senior Advocate Gopal Sankaranarayanan, along with Advocate-on-Record Neha Rathi, appeared for the petitioner and presented the initial submissions.
The petition calls for the constitution of an expert committee headed by a retired Supreme Court or High Court judge to formulate a model framework for persons who have been unjustly detained, spent prolonged periods in custody, and were later acquitted or discharged.
It further seeks the establishment of uniform national standards for monetary and non-monetary relief—such as compensation, counselling, livelihood support and social reintegration—along with the creation of a dedicated fund for victims whose fundamental rights were violated during detention.
The Court has listed the matter for further hearing after four weeks.
