Centre Bans Over-the-Counter Sale of Cough Syrups; Doctor’s Prescription Mandatory

New Delhi (IANS): The Central government on Tuesday banned the over-the-counter (OTC) sale of all syrup-based medicines, including cough syrups, across India without a valid doctor’s prescription.

By enacting the Drugs (Fifth Amendment) Rules, 2026, the Union Health Ministry amended the historic Drugs Rules, 1945, to scrub the word “syrups” from a list of exempted medications under Schedule K. The drastic policy shift aims to curb drug abuse, prevent self-medication, and tighten regulatory control over the manufacturing and distribution of liquid formulations.

Closing the Rural Loophole

Previously, Schedule K permitted vendors in small villages with populations under 1,000 to sell cough syrups without a formal retail drug license. This loophole was intended to make basic healthcare accessible in remote areas.

The new amendment completely revokes this privilege. Moving forward:

  • Licensed Pharmacies Only: Vendors can only dispense cough syrups through pharmacies officially licensed under the Drugs and Cosmetics Act, 1940.
  • Prescription Required: Customers nationwide must present a physical or digital prescription from a registered medical practitioner to purchase any syrup-based medication.

Aligning with Public Health Safety

The Health Ministry introduced the amendment to align India’s pharmaceutical framework with modern public health and safety demands. Officials stated that unregulated access to these formulations poses significant risks, particularly concerning codeine-based syrups and unmonitored paediatric dosing.

“We advise all manufacturers, distributors, and retailers dealing in cough syrups to ensure immediate and strict compliance with the updated licensing requirements,” the Ministry statement read.

The government expects the crackdown to enforce responsible distribution networks and ensure that pharmaceutical supply chains remain transparent and compliant with national standards.
