Jharkhand: Babulal Marandi files contempt petition in SC against DGP appointment 

Ranchi, February 20: BJP state president Babulal Marandi has filed a contempt petition in the Supreme Court. He has raised questions on Anurag Gupta being made the regular DGP by the Jharkhand government.

The petition is expected to be listed on February 24. In this case, he has made the state’s chief secretary Alka Tiwari, principal secretary of home department Vandana Dadel, DGP Anurag Gupta, retired cum nomination committee chairman Justice Ratnakar Bhengra and former DGP Neeraj Sinha as respondents.

Supreme Court advocate Kumar Mihir has filed a contempt petition on behalf of Babulal Marandi on February 13.

Babulal Marandi’s advocate Kumar Mihir has given several reasons for the appointment of Anurag Gupta as regular DGP as illegal. For example, making Anurag Gupta acting DGP on 25 July 2024 is a violation of the Supreme Court order of 3 July 2018 in the case of Writ Civil No. 310/1996. Also, after the assembly elections were over, on 28 November 2024, Ajay Kumar Singh was removed from the post of DGP and Anurag Gupta was made acting DGP. Doing so is a violation of the Supreme Court’s decision of 3 July 2018 in Writ Civil No. 310/1996.

The contempt petition states that as per the Supreme Court order in WP (C) No. 310/1996 case dated 22 September 2006, the Director General of Police of the state will be selected by the state government from among the three senior-most officers of the department.

He will be empanelled by UPSC for promotion to that post on the basis of his length of service, very good record and experience of heading the police force. Once he is selected for the job, his minimum tenure should be of two years irrespective of his date of retirement.

In case of any action under the rule, conviction in a criminal or corruption case, he will be removed in consultation with the state security commission.
