BJP leader moves to Supreme Court seeking removal of �Tiranga�

: Firebrand BJP leader and State BJP spokesperson Amarpreet Singh Kale has filed a writ petition ( civil) at Supreme Court of India against different political parties using the Tri-colour in their flags in respect to the National Flag.

The petition ( 62/2014) was filed on January 6, 2014 at New Delhi. The apex court has also taken cognizance of the writ and has scheduled February 7, 2014 for hearing.

Citing ACT, 1950 (12 OF 1950) of Emblems the petition has been filed.

The Act prevents the improper use of certain emblems and names for professional and commercial purposes.

Speaking over the phone from New Delhi, Kale�s lawyer Ankur Mittal said that a petition has been filed in this regard.

He said that it is first of its kind petition filed against miss use of the National Flag by different political parties. Earlier only cases related to miss use of National Flag by common people were discussed.

When contacted, Kale too confirmed that a petition has been filed in this regard. He said that Congress Party, Trinamool Congress and NCP are using Tri-colour.

He went on to add that the Congress flag especially confuses people with that of the national flag and the Congress party must not take undue advantage. “The only difference between the two flags is the Congress’ symbol which has changed from time to time,” he said.

He demanded banning on the use by any political party of the three colours of the national flag, so that there could be no confusion among the people.

�The Congress has exploited sentiments of common people and has emotionally blackmailed countrymen by using the Tricolour which has three colours in the same order as the National Flag,� he noted.

�As a common citizen of the country too I am concerned over the miss use of the Tri-colour. We need to honour our national flag in a most fitting manner. I believe the Congress must do away with Tiranga pattern,� he said.

�It is not possible to distinguish the colours of the Congress flag from those of the national flag. It has been the opinion of the millions in this country. A political party should not use such a flag that confuses the countrymen,� he said.
