Tata steel wins battle against Sanjukta Sewa Sahyog Samity

Jamshedpur, Feb 10: On February 8, 2014, Tata Steel got the delivery of possession of the quarter allotted to Sanjukta Sewa Sahyog Samity after a long fought battle
in the Court since 2004.

Tata Steel had allotted the Quarter Number TJ2/26, Cosai Road, Old Baridih to Sanjukta Sewa Sahyog Samity, a registered Society, under the Societies Registration Act in the year 1975. Thereafter in the year 2004, Tata Steel had filed Eviction Suit numbered as ES No. 68 of 2004 (Tata Steel Vs Sanjukta Sewa Sahyog Samity) on the ground of bonafide requirement of quarter
for its employees.

The suit was contested and finally decreed in favour of Company in the year 2009. However when the party did not vacate the quarter, the Company put the decree into execution in EX Case No. 5 of 2010 (Tata Steel Vs Sanjukta Sewa Sahyog Samity) for taking delivery of possession of the quarter through the process of Court.

During the pendency of execution proceedings, the party filed Appeal, numbered as EA 18 of 2009 (Sanjukta Sewa Sahyog Samity Vs Tata Steel) before Court of District Judge, Jamshedpur and as there was no stay of the execution proceedings, in the appeal, court of Munsif, Jamshedpur issued the Writ of delivery of possession of the quarter.

The delivery of possession of quarter was taken with the help of Nazir of the Court and assistance of the police.
