Jamshedpur, September 13: The hearing of the Incab case on resolution plan of Vedanta’s was held in NCLT Kolkata on Monday in the bench of Balraj Joshi and Rohit Kapoor.
RP Pankaj Tibrewal’s advocate said during the hearing that a resolution plan of Rs 545 crores has been given by Vedanta, which was earlier only 110 crores. He told the Bench that this resolution plan has been approved by the Committee of Creditors with 99 per cent votes. The advocate also said that Vedanta is a big name and we are giving Rs 545 crores, which includes Rs 15 crores for laborers.
“We will revive the company which will generate employment for many people. Therefore, the Honourable Bench should pass the order of acquisition of INCAB.
The bench asked how much is the claim of the workers? On this, it was told by the advocate of the workers that their claim is Rs 254 crores in which the RP has arbitrarily approved 187 crores and in this resolution plan there is only a provision of 15 crores for the workers.
In the case of 177 acres of Incab land, Akhilesh Srivastava, while giving his side, said that the NCLT had declared the Incab land out of its jurisdiction and declared the lease of Tata Steel by its order of 7.2.2020.
That order was quashed by the Hon’ble NCLAT vide its order dated 4.6.2021, which has been approved by the Supreme Court. A writ has also been filed on this issue in the Ranchi High Court. The NCLAT has not given any arrangement in the matter of Incab land keeping in view the case number CMP 187/2020 filed in the Jharkhand High Court. Due to paucity of time, the hearing on the application containing the resolution plan of RP could not be completed.
The bench again said that it will first hear the resolution plan and before passing any order, it will hear the petition and all other applications in the light of the orders of Hon’ble NCLAT and Hon’ble Supreme Court. The next hearing on several applications of Bhagwati Singh will be held on 21.10.22. Advocates Akhilesh Srivastava and Akash Sharma participated on behalf of the employees.
