Jamshedpur, October 14:Now land registry can be started in Jamshedpur Tata Lease area.
The court of Justice Gautam Kumar Chaudhary of Jharkhand High Court has given this decision in the case of 59 sublease of the city by the Appropriate Machinery Committee (AMC) formed for allotment of lease land in Jamshedpur.
Earlier, after the completion of the hearing in the case on August 21, 2023, the court had reserved its decision. Before this, senior advocate Anil Kumar presented his side on behalf of the applicant. Advocate Inderjit Sinha and advocate Pooja Aggarwal represented the defendant Tata Steel in the case.
The court has issued this order after hearing the petition of Ashiana House Limited and Parikh Inn Private Limited.
An order related to this matter has been given by combining two separate petitions in the court for the last 11 years.
In the decision taken in this case, after analyzing 12 different points, the High Court has cancelled the status-quo order issued by the deputy commissioner in the year 2012 in the case of 59 sublease.
Besides, the role of the state government in this entire matter has also been clearly defined. The court has said that there is no need to present this matter before the cabinet again. In its order, the court has considered the Appropriate Machinery Committee (AMC) as the competent authority in the matter of issuing leases.
While giving direction to Tata Steel Company, a clear order has been given to get the registration of 59 subleases done. The court has also rejected the argument of loss to the state government due to the revenue from sublease.
The court has said that Tata Steel can take the decision of sublease for the development and industrial development of the city as well as to provide employment opportunities to the people.
In this case, the petitioners had made the Jharkhand Government, Divisional Commissioner of Kolhan, DC of East Singhbhum, Tata Steel and Jamshedpur Notified Area Committee as respondents.
During the hearing of the case, it was told by the administration that this matter has been under consideration at the state government level since 2015. The court also gave the state government an opportunity to present its stand in this matter.
The state government said that the matter is under consideration.
