Jamshedpur, May 25: NCLT Kolkata bench of Harishchandra Suri and Rohit Kapoor heard the Incab company case on Wednesday.
After hearing the bench allowed to extend the resolution process for 30 days. Along with this, an order was given to take cognizance of the resolution plan given by Vedanta.
Earlier, RP Pankaj Tibrewal said that the committee of creditors (CoC) is taking cognizance of the resolution plan given by Vedanta. In such a situation, the time for the process of insolvency resolution should be extended by 30 days. His counsel told the bench that he has presented the resolution in the bench which is supported by 97 percent committee of creditors. This will revive the company.
In this situation, it should be accepted after hearing it.
Advocates of all the parties said that when the CoC was formed illegally, then how can the CoC pass the resolution plan. Then after hearing everyone’s side, the bench asked Vedanta’s resolution plan to be taken into consideration, while allowing extension of the resolution process for thirty days.
The bench also fixed 27 June 2022 for the next hearing of all other applications.
