Ranchi, April 8: A hearing was held in the Jharkhand High Court on Monday in the matter of issuing notification of Jharkhand municipal body elections in three weeks.
This hearing took place in the court of Justice Chandrashekhar and Justice Navneet Kumar. This double bench court of the High Court rejected the appeal of the government in which it had challenged the decision of Justice Ananda Sen.
The court asked the government to present all its aspects related to this case before the court. For this it has given two weeks’ time. This case will be heard again after two weeks.
Actually the matter is that councilors Roshni Khalkho and Arun Jha had filed a petition in the High Court regarding issuing notification of Jharkhand municipal elections. While hearing this case, Justice Anand Sen’s court directed the government to issue a notification within three weeks. In this case, the government cited the Supreme Court’s law of triple test.
Jharkhand government, while presenting its stand in the court, had said that the Supreme Court has said to conduct civic elections only after conducting triple test. Whereas triple test has not been done in the state yet. On this reply of the government, advocate Vinod Singh, representing the petitioners, described the government’s reply as misleading. He said that the government is not only violating the 74th and other provisions, but is also misleading the court by keeping it in the dark with half-hearted answers.
Incidentally, due to non-holding of municipal elections, the grant of about Rs 1600 crore received by the Jharkhand government from the 15th Finance Commission has got stuck. The state gets this amount for the development of cities and civic amenities of the state.
