Ranchi (IANS) — The Jharkhand High Court on Thursday directed the Garhwa district administration to immediately extend government welfare and rehabilitation benefits to around 300 rescued bonded labourers settled in the region.
Authorities had rescued these labourers from various districts of Uttar Pradesh nearly 34 years ago, in 1992.
A division bench of Chief Justice S.M. Sonak and Justice Rajesh Shankar passed the landmark order while hearing a Public Interest Litigation (PIL) filed by social activist Ghanshyam Pathak.
Decades of Administrative Neglect
According to the petition, after their rescue in 1992, a significant number of the freed workers migrated and settled in Jharkhand’s Garhwa district.
However, despite the passage of more than three decades, successive administrations failed to provide them with statutory rehabilitation assistance under the Bonded Labour System (Abolition) Act, 1976. The state also left them out of basic welfare schemes concerning:
- Housing and clean drinking water
- Healthcare and medical assistance
- Employment generation and pension schemes
Court Slams Bureaucratic Paperwork
Pathak filed the PIL in 2023, prompting the High Court to repeatedly demand answers from regional authorities.
During Thursday’s hearing, the petitioner’s counsel revealed that over the past three years, district officials merely exchanged bureaucratic correspondence without delivering a single shred of actual relief on the ground. This red tape effectively deprived the aging labourers of their legal guarantees.
Expressing deep dissatisfaction with the prolonged delay, the division bench observed that the system cannot deny eligible citizens their rightful benefits for an extended period.
The Court’s Directive: The bench ordered the Garhwa Deputy Commissioner to personally identify all surviving eligible labourers. The administration must ensure they receive direct financial aid under the anti-bonded labour law alongside standard welfare benefits.
The High Court explicitly warned that mere paperwork would no longer suffice, ordering authorities to ensure the physical delivery of benefits to the beneficiaries.
