Jamshedpur, October 14: The division bench of Jharkhand High Court Chief Justice Sanjaya Mishra and Justice Anand Sen issued an order regarding the case filed by parking contractors Putul Pandey and Nishikant Singh against Jamshedpur Access (JNAC).
Issuing the order, JNAC was directed to return the security deposit amount of Rs 8,50,000 and Rs 29,35,000 deposited by the tender holders (parking contractors) at the rate of 6 percent interest within 60 days of the passing of the order.
The hearing of the writ petitions numbers 2156/2023 and 2160/2023 filed against the Special Officer of JNAC was held on September 19, after which the order was reserved. It is noteworthy that JNAC had given both the contractors the right to collect parking fees in the Sakchi Bazaar area.
But it was almost impossible for both the contractors to collect parking fees due to illegal occupation of the areas earmarked for parking.
According to the agreement, JNAC had to cordon off the parking area, which it did not do even after being informed dozens of times. In the case of Nishikant Singh, the Deputy Commissioner of Jamshedpur even stopped charging for parking in the previously allotted area and JNAC arbitrarily allotted him a new area away from Sakchi market, which JNAC neither cordoned off nor allowed two-wheelers in the market.
Both the contractors had demanded the return of their security money in view of the violation of the agreement by JNAC but JNAC instead directed these contractors to deposit the further instalment.
