SC Grants Bail to IAS Officer Vinay Choubey in Corruption Case

New Delhi / Ranchi: The Supreme Court of India granted bail to Jharkhand cadre IAS officer Vinay Kumar Choubey on Monday. The apex court overturned an earlier Jharkhand High Court order that had denied the officer relief.

A bench comprising Justices B.V. Nagarathna and Ujjal Bhuyan heard the criminal appeal challenging the High Court’s January 6 decision. That previous ruling had rejected Choubey’s bail plea regarding FIR No. 09/2025, registered by the Anti-Corruption Bureau (ACB) in Hazaribagh. The case involves allegations of criminal breach of trust, cheating, forgery, criminal conspiracy, and violations of the Prevention of Corruption Act.


Key Arguments in Court

During the proceedings, both sides presented contrasting arguments:

  • The Defense: Senior counsel for Choubey argued that while the alleged offenses date back to 2009, authorities only arrested him on August 13, 2025. Counsel emphasized that the officer has remained in judicial custody ever since. Furthermore, the defense highlighted that two co-accused had already secured bail, invoking the principle of parity.

  • The Prosecution: The state government opposed the plea, contending that Choubey played a pivotal role in land transfer irregularities during his tenure as Deputy Commissioner. The state argued his high-ranking position distinguished him from other accused individuals and pointed to his alleged links to other cases.

The Court’s Decision

The Supreme Court bench observed that Choubey’s duration in custody and the treatment of his co-accused justified granting bail. Consequently, the bench set aside the High Court’s order and directed the trial court to release Choubey under stringent conditions.

The Court mandated that the officer must:

  1. Fully cooperate with the ongoing trial.

  2. Refrain from influencing witnesses.

  3. Avoid tampering with any evidence.

The bench cautioned that any violation of these terms would result in the immediate cancellation of his bail. This ruling marks a crucial development in the high-profile case as the trial moves forward.
