CM Hemant’s plea against ED’s summons will be heard by HC today

Ranchi: A criminal writ petition filed by Chief Minister Hemant Soren is scheduled to be heard in the Jharkhand High Court on October 13. In today’s hearing, ED is likely to present its side. Let it be known that the CM has challenged the ED’s summons and its authority in the petition. Along with this, the validity of Section-50 and 63 of PMLA-2002 has also been challenged. In which he has said that these clauses violate the fundamental rights given by the constitution. It is known that the CM had reached the High Court on September 22. Today’s hearing is listed in the bench of Chief Justice Sanjay Kumar Mishra and Justice Anand Sen.
It is significant that ED has sent five summons to the CM but he has not appeared before the ED on any of the summons. The ED sent the fourth summons to the Chief Minister on September 23 for questioning in the land purchase and sale case. When he did not appear, the ED issued a fifth summons on September 26 and summoned him for questioning on October 4. Despite this, he did not appear in the ED office.

ED will present its case today. A separate date will not be fixed in this case. While hearing this case on Wednesday, the bench of Chief Justice Sanjay Kumar Mishra and Justice Anand Sen of the Jharkhand High Court made this clear comment. The court said that during the previous hearing, it was said on behalf of Hemant Soren that the senior advocate of Delhi will appear in the court and defend the case. During this time, there was a demand to fix the date of October 11. Then the court asked Hemant Soren on 11th and ED to appear on 13th October.

He said, ED has not filed any FIR against Hemant. No criminal case is pending against him. Whether ED has summoned Hemant Soren as a witness or an accused is also not clear so the summons should be quashed. Meanwhile, Chidambaram told the court that a review petition has been filed in the Supreme Court in a similar case. The High Court should hear the petition only after its execution and he urged the court to fix the hearing on the petition on October 18.
