The Supreme Court on Tuesday widened its scrutiny regarding the appointment of Jharkhand Police Chief Tadasha Mishra. The court sought details from the Centre on DGP selection frameworks across all states.
A three-judge bench led by Chief Justice Surya Kant asked the Centre for a consolidated account of national DGP selection rules. The bench issued this directive following arguments from amicus curiae Raju Ramachandran.
Ramachandran urged the apex court to assess state rules against its landmark 2006 Prakash Singh judgment. He noted that states like Uttar Pradesh and Punjab framed regulations similar to Jharkhand while claiming compliance.
The Chief Justice agreed to examine existing legislative and executive regimes holistically. Consequently, the bench directed the amicus curiae to submit a comprehensive note for circulation among all parties.
This legal battle focuses on Mishra’s appointment on December 30, 2025, just one day before her scheduled retirement. The Centre actively challenged Jharkhand’s 2025 police regulation that enabled her appointment.
According to the Centre, Jharkhand amended its rules on December 29, 2025, to grant Mishra a full two-year tenure. The Centre argued this action directly violated the Supreme Court’s prescribed selection procedure.
The court ordered the Jharkhand government and Mishra to file formal responses by November 16. The Centre also challenged the earlier appointment of DGP Anurag Kumar Gupta under similar circumstances.
Solicitor General Tushar Mehta urged the court to prioritize the Jharkhand matter due to rule violations. Meanwhile, senior advocate Kapil Sibal confirmed that Jharkhand would present its official stance.
The court previously observed that Jharkhand’s regulation prima facie contradicted the 2006 judicial framework. That binding 2006 ruling requires states to select DGPs from UPSC empanelment lists for minimum two-year tenures.
This ongoing proceeding will impact police chief appointments across the country as the court evaluates state compliance.
