Ranchi: The Supreme Court has expressed surprise over the decision of the Jharkhand High Court, in which the amount of maintenance given to a woman by her former husband was reduced from Rs 5,000 to Rs 1,000 per month. This case is from Giridih district of Jharkhand.
There was a dispute going on between a couple here, in which the Chief Justice of the Family Court had ordered the husband to pay a maintenance amount of Rs 5,000 per month to the woman. The woman’s ex-husband had appealed against this decision in the Jharkhand High Court.
While hearing this, the High Court had reduced the amount of maintenance from Rs 5,000 to Rs 1,000 per month. The woman took refuge in the Supreme Court against the decision of the High Court. While hearing his petition, Justice Vikram Nath and Justice Ahsanuddin Amanullah said that the order to reduce the amount of maintenance to only Rs 1,000 per month is shocking.
The Supreme Court reinstated the order to pay Rs 5,000 per month to the woman as maintenance under Section 125 of the Code of Criminal Procedure 1973.
