Jamshedpur, March 9 : The National Company Law Appellate Tribunal (NCLAT), New Delhi, on Monday heard Company Appeal (AT) (INS) No. 224 of 2026 filed by the Employees’ Provident Fund Organisation (EPFO) against Incab Industries Limited and other respondents, granting additional time for filing a delay condonation application.
The matter was heard in hybrid mode by the tribunal. During the proceedings, counsel for the respondents, Shunak Mitra, requested time to submit the delay condonation application. Accepting the request, the tribunal granted three days’ time to file the application.
During the hearing, Abhishek Anand, appearing for the Successful Resolution Applicant (SRA), informed the tribunal that the resolution plan has already been approved and now needs to be implemented.
Taking note of the submission, the tribunal directed the appellant to take necessary steps within two weeks for the implementation of the SRA.
The tribunal further permitted the SRA to file its reply to the delay condonation application within two weeks after the application is submitted.
After recording the submissions of the counsels, the tribunal listed the matter for the next hearing on April 6, when further developments in the case will be reviewed.
The appeal involves issues related to claims and proceedings concerning Incab Industries Limited, with EPFO seeking legal remedies before the appellate tribunal under insolvency proceedings.
