Jharkhand: High level committee submits report on inadequate SC/ST representation in government post

Ranchi, Nov 3:  A three-member high-level committee of Jharkhand submitted a study report on the inadequate representation of Scheduled Castes and Scheduled Tribes in the creamy layer of promotion, administrative efficiency under Government Services and Posts.


The following reports were received during the study. Out of 34 departments, 29 departments have submitted their reports offline on the total number of posts filled on the basis of direct appointment or promotion including caste category wise number of employees and 10 departments have submitted the report along with the service category wise number of employees working in each caste category in these services.

According to the data received from HRMS, the total number of sanctioned posts in the state is 3,01,198 in 31 major departments in 34 departments, out of which 57,182 posts are to be filled on the basis of promotion while 2,44,016 posts are to be filled by direct appointment. 

Keeping in view the constraints of availability of database, the Committee decided to devise a methodology, especially in respect of promotions in certain departments, which would enable the Committee to conduct an evaluation in a transparent and time-bound manner.

The committee had access to reliable data on promotions of employees by which various reports were prepared and analysed.


The committee also considered the view of the Supreme Court in the case of Jarnail Singh . The following is a summary of the judgment of Jarnail Singh Case (SLP) (C) 30621/2011


 “Thus we clarify that on the inadequacy of representation, the quantitative data will be collected by the State on the parameters laid down in the Nagaraj case, which can be checked by the courts. We may further add that the data will pertain to the cadre concerned.


The high power committee recommended, that It is clear from the compiled and analyzed data that there is inadequacy of representation of Scheduled Castes and Scheduled Tribes in promotion posts at every level in the Government. The percentage of Scheduled Caste and Scheduled Tribe employees belonging to the total number of employees holding posts on the basis of promotion against the sanctioned promotion posts across the state is 4.45 and 10.04 percent respectively, which is higher than that of Scheduled Castes and Scheduled Tribes (12.08 percent respectively) in the State. (SC) and much less than the demographic ratio of 26.20 per cent (ST).

The committee in its report states that since the representation of Scheduled Castes and Scheduled Tribes in the services of the State is far below the required level, it is necessary to continue with the present policy of reservation in promotion. At this stage, any relaxation of the existing provision or removal of any clause would not be justified or desirable and would be against the interest of the community at large.

The committee also recommended that  Jharkhand Public Service Commission (JPSC) and Jharkhand Staff Selection Commission (JSSC) and Department of Personnel Administrative Reforms and Official Language also need to maintain the database of results with year-wise and category wise details of how many SC, ST, OBC unreserved Qualified under the category.

A separate cell should be created under Personnel Department for more rigorous and continuous monitoring to ensure strict adherence to the reservation policy and its provisions by all departments.

The Department of Personnel, Administrative Reforms and Official Language must publish annual reports on recruitments, promotions and other related information.
