Ranchi, July 2 : The Jharkhand High Court had on 4.5.2023, in the Writ Petition No. 2078/2018 of the petitioner Rakesh Kumar Jha, directed Jamshedpur Notified Area Committee (JNAC) to file a status report on the compliance of the Hon’ble High Court order of 2011.
In the status report filed by JNAC, the court has been informed that it has not complied with the 2011 order of the High Court in the last 12 years but promises to comply. Thus JNAC has committed open contempt of court.
The counsel for the petitioner told today that according to the 2016 Model Building Byelaws of the Union Ministry of Urban Development, 75% to 33% construction in 300 to 3000 square meter plot areas and 100 to 200% Floor Area Ratio ( Floor Area Ratio) is allowed thus no construction in Jamshedpur can be more than G+3.
On the other hand, the Jharkhand Building Byelaws have linked the construction to the width of the road, according to which buildings higher than G+4 cannot be constructed in Jamshedpur if the width of the road is 20 to 24 feet.
But there are about 1246 illegal constructions in Jamshedpur in which all the builders have constructed 100% – 110% instead of 33% to 50%, G+7 instead of G+3, parking spaces have been converted for commercial use.
Companies like TK Complex, Bistupur were given land to build multiple parking lot, violating which they have built commercial complex on the whole land and in construction have encroached the road land also due to which the vehicles are parked directly outside that building on the road.
The petitioner alleged that due to the sale of parking spaces as commercial units, the city roads have turned into parking spaces and walking on the road has become difficult. On top of that, by auctioning the roads, JNAC has made it a source of illegal income.
The petitioner claimed that such illegal and unconstitutional actions and circumstances have been brought to the notice of the High Court through a supplementary affidavit. He said that in order to stop all these illegal constructions, the rights of institutions like Tata Steel, Deputy Commissioner and JNAC have to be abolished immediately.
The petitioner claimed that many people have approached for filing direct writ against JNAC and this new writ will be filed soon in the High Court so that all the hearings can be held together.
