Jamshedpur: The District Additional and Sessions Judge (III), Niti Kumari, has rejected the anticipatory bail applications of two accused, Sushma Pandey and Ranjit Kumar, in a Rs 30 lakh embezzlement case linked to Muzaffarpur, Bihar. Both accused are residents of Chintamanpur Adwara under Bariarpur police station in Muzaffarpur district.
At the same time, the court granted anticipatory bail to the other two accused in the case, Nishant Kumar and Ayush Kumar, with strict conditions. The court directed them to surrender before the court within three weeks, obtain the bail order, and extend full cooperation to the investigating officer during the course of the investigation.
The case relates to a complaint filed by Sanjay Kumar, owner of Care Traders and a resident of Sonari, Jamshedpur. Based on his complaint, an FIR was lodged at the Sakchi police station against all four accused.
According to the prosecution, Ayush Kumar and Shatrunjay Singh had initially visited the complainant’s office and introduced him to Ranjit Kumar and Sushma Pandey. The accused allegedly informed Sanjay Kumar about a fire safety work contract worth Rs 50 lakh and a scrap shifting contract worth Rs 2 crore from MRPL, Mangalore, and assured him of substantial profits if he undertook the work.
The complainant stated that he received the work order in November 2023 and commenced the work. However, after about six months, the accused allegedly increased the royalty rate and withheld TDS and GST amounts. Despite completion of the work, a sum of Rs 30,87,586 reportedly remained unpaid.
The matter took a serious turn when, after a legal notice was issued, the accused allegedly visited the complainant’s office and produced a receipt claiming that the outstanding amount had already been paid. Sanjay Kumar alleged before the court that the signature on the receipt was forged and did not belong to him.
The complainant was represented in court by Advocate Sudhir Kumar Pappu, former Public Prosecutor Sushil Kumar Jaiswal, and Advocate Babita Jain, who opposed the anticipatory bail pleas of the accused.
The court, after hearing arguments from both sides and examining the case records, rejected the anticipatory bail applications of Sushma Pandey and Ranjit Kumar, while granting conditional relief to the remaining two accused.
