Jamshedpur, March 22: Jamshedpur East MLA Saryu Roy during the debate on the demands of the revenue department raised the demand for ownership rights to the settlements of Jamshedpur in the assembly on Tuesday.
The Independent MLA that in several meeting he had written to the Chief Secretary and Revenue Secretary, and said that the government should implement a plan to give ownership rights to the residents of their settlements soon.
Roy cited the Supreme Court’s decision on 6 February 1981 in the case of Kshitij Chandra Bose Vs Commissioner, Ranchi and Ranchi Municipal Corporation and said that this decision is published in AIR 707 and SSC 103.
According to order,, if there is continuous possession of any government land for a maximum period of 30 years and the possession has not been removed by the government, then according to the principle of adverse possession, the occupier will be considered to be the owner of that land and said that the government should give the ownership of land to such persons.
He said that in such settlements, works worth billions of rupees have been done from MLA fund, city development fund, finance commission fund, central government aid fund. Roads have been built, drains and drains have been made, electricity has been installed, drinking water is being provided, cleanliness is being done, other facilities are being provided. If they are not getting it, then they are not getting the ownership rights and are not getting the holdings number. He said that government will get billions of rupees in revenue, while public will benefit with civic facilities.
He expressed surprise that the work which is beneficial to both the government and the people, that work was not done by the previous government and even after giving assurances and holding meetings, the present government is not doing it. While the Haryana government is doing this, the same has happened in Madhya Pradesh, the Indore municipality has also done it. The previous government has complicated the matter by providing lease in lieu of ownership. It is my demand that the present government should solve this.
